The Prosecutor’s Office of the National Court (AN) has informed the judge of the National Court Joaquín Gadea in favor of assuming the investigation against Hamza Warris, the Pakistani citizen who on March 27 caused damage with an ax to the windows of a McDonalds located in the Màgic Badalona shopping center (Barcelona).

Through a press release, collected by Europa Press, the Public Ministry has indicated that prosecutor Raquel de Miguel has issued a report in which she maintains that the events would constitute an alleged crime of integration or collaboration with a terrorist organization, being of violent action individually or alone, in compliance with the tenets of Jihad.

The Prosecutor’s Office details that the investigated person went to the shopping center “dressed with a Palestinian scarf on his head as a previous liturgy and carrying a large ax with which in the middle of the public street, at a place and time where he was a large crowd of people went to the McDonald’s establishment in the center”.

Once inside, the Prosecutor’s Office reports, “he began to brandish the ax, attacking a display case with it and fracturing the glass of one of the windows, causing a climate of terror and collective hysteria.” “The subject was intercepted by a citizen who had to avoid his action with the axe, managing to immobilize him,” the note adds.

It should be noted that Warris is in provisional detention after the Investigative Court Number 4 agreed to do so on March 29. That same court was the one that inhibited itself in favor of the National Court.

Legal sources informed Europa Press that the matter fell by distribution to the reinforcement magistrate of the Central Court of Instruction Number 6, who asked the Prosecutor’s Office to issue a report on jurisdiction. Now, it will be the judge who decides whether the National Court takes up the case.
