The person who wishes to work for a company from home sales has, in effect, the choice between three different legal statuses : seller to home independent (VDI), a commercial agent or trader.
For the seller, a beginner, who just wants to engage in an activity to bystanders, the status of VDI is the most suitable. It is also the most used : six out of ten companies use to trade under this statute. Created in 1993 by the Federation of direct selling (FVD) to fill a legal vacuum, the status of VDI has many advantages. The VDI has an independent status but it has specific arrangements.

for Tax purposes, the VDI falls within the regime independent : a system of non-commercial profits (BNC) if it is VDI or agent of the industrial and commercial profits (BIC) if it is VDI buyer dealer (read below). For the social protection, it is attached to the general regime of social Security and is entitled to the same social rights as employees.

Another advantage of the statute : the VDI can work with several companies of home sale, provided they are not competing. Thus, it is possible to sell at the same time the products of a cosmetics company and a company of lingerie.
In addition, this status allows job seekers who make occasional sales to continue to receive their unemployment benefits. They must then meet two conditions : be registered on the list of job seekers (and find an effective and permanent employment) and not win in the month over 70 % of the previous wage on which unemployment allowance has been calculated.
The status of VDI, however, is limited in time. If the seller to home independent earns a gross annual salary of more than 50 % of the annual ceiling of the social Security (19 308 euros for 2016) for three consecutive years, it loses its status of VDI. It must then be entered, either in the register of commerce and companies, either in the special register of commercial agents. This registration must occur from the 1st of January following the three calendar years.
Two types of contracts : agent or dealer
The seller to home independent can be offered two types of different contracts that, without changing his social status, alter the nature of the business relationship between the company, the client and him : thus it may be VDI agent or VDI buyer dealer. When it is agent, the contract stipulates that the company (the principal) gives to the seller (the agent) the power to make orders with the customer in the name and for the account of the company. The company remains the owner of the goods and the seller does not have to purchase it.
When it is the buyer-dealer, the contract stipulates that the seller buys and then resells the goods supplied by the direct sales business. The seller benefits from volume discounts on the products it resells and delivers to its customers with a profit margin.

Nothing very complicated ! When it starts its activity, the VDI should just make a declaration of start of activity with the Urssaf.
The status of VDI opens rights to sickness benefits, daily allowances, and retirement.
If the seller does not contribute not to the insurance under another occupational activity (and that it is not in retirement or unemployment), it may be liable to pay a contribution if their income is greater than 9 611 euros (value 2016).
The VDI acquires pension rights according to his or her compensation. The threshold to validate a quarter is 150 times the hourly Minimum wage, or 1 441,50 euros per quarter in 2016.
Then, it is the company that deals with the contract of employment that states the terms of remuneration and status (agent, buyer-reseller).
A commission of 20% to 35% on sales
The seller to home independent is paid by a commission taken on sales. It varies from 20% to 35% according to the enterprises and the turnover achieved by the seller.
For example, a good seller, in the fashion industry for children, can expect to earn up to 3 000 euros per month. The income naturally varies according to the time spent on the home sale, but also to the ability to build a super-network of clients and the talents of a seller.
