The trial has been postponed until February 3, 2023

The lawyers of tennis player Nick Kyrgios requested that the accusation against the Australian be dismissed due to mental health problems on charges of assaulting a former partner, for which the trial was postponed until February 2023.

Kyrgios was accused in July of this year of allegedly assaulting a former partner in January 2021. The tennis player’s lawyer, Michael Kukulies-Smith, asked that the case be postponed so that the athlete’s forensic mental health reports could be prepared, which He was not in the hearing held this Tuesday in Canberra, since he is participating in the tournament in Tokyo, in Japan.

After this, the case was adjourned until February 3, 2023 by Magistrate Glenn Theakston. After this, legal representatives for Kyrgios, who faces a maximum sentence of two years in prison, are expected to request that the case be dismissed. Thus, Kukulies-Smith claimed that she was completing the application for it, having reviewed Kyrgios’ “medical history from 2015, including public disclosures of his mental health issues.”

Australian law dictates that magistrates have the power to dismiss a case if they believe an accused person has a mental disability, considering that treating a case in such a way would be beneficial to both the accused and the public.
