The judge of ‘Titella’ refuses to annul or lower the bail for José Luis Moreno due to the “current status” of the case

The judge of the National Court in charge of the investigation of the ‘Titella case’ has rejected the request of the television producer José Luis Moreno to annul or reduce the bail agreed for his provisional release “in the current state of processing of these proceedings”.

In an order this Monday, to which Europa Press has had access, the head of the Central Court of Instruction Number 2, Ismael Moreno, aligns himself with the criteria of the prosecutor, who opposed the claim of the ventriloquist, assuring that “the circumstances that were taken into account at the time of its adoption”, reinforcing in the same way “the indications of criminality”.

It was on May 25 when Moreno’s defense team sent a letter to the magistrate requesting the annulment or reduction of the bail, alleging that an “excessive amount” could be a “discriminatory obstacle” to the right to freedom, which would transcend the precautionary measure and would become a “punitive” element for its “excess”.

Specifically, his representation urged that he cancel it or reduce it to one million euros, after in December he already agreed to reduce it to 2 million compared to the 3 million that he initially imposed in 2021.

The television producer argued that there is no longer any reason for those who caused this precautionary measure due to the “non-existent” risk of flight and indicates that the bail cannot be an “impossibility” or that it “entails the unavailability of all his personal assets”. And he defended that he is 75 years old, is rooted in Spain and has a home in Madrid, has no criminal and police record, or that he has appeared every week before the judicial authority.

In that same letter, in addition, Moreno’s lawyer argued that in February he already presented a mortgage before a notary as a guarantee for provisional release on seven farms valued at just over four million euros.

However, the instructor makes it clear that “contrary to what was stated by his procedural representation, the mortgage bond has not yet been constituted as the corresponding deed has not been registered in the Property Registry, despite the requirements made in that regard.”

On the other hand, the magistrate responds to the allegations that Moreno’s defense presented on May 12 and where the indiciary crimes attributed to the ventriloquist on his alleged participation in events that could be provisionally classified as constituting crimes of belonging to a criminal organization were challenged. , false documents, fraud, money laundering and against the Public Treasury.

“On these previous extremes, at this procedural moment, no pronouncement is appropriate, since various investigation procedures necessary to determine the nature and circumstances of the fact are pending,” explains the judge.
