Refuses to review another because in this case the current law provides for the same penalties as the previous one

The Court of Lleida has reduced five sentences by reviewing sentences in application of the law of ‘only yes is yes’, according to the records consulted by Europa Press.

In one case, the sentence of a man who in 2019 was convicted of continuous sexual abuse of a minor has been reduced from 10 to 9 years in prison, and the magistrates recall that the law that most favors the prisoner must be applied retroactively: before, the minimum for this crime they were 8 years and now they are 6, and for this reason they adjust the sentence so that it remains in the upper half of the fork provided by law.

The court has also reduced from 12 to 11 years in prison the sentences of two men who in 2019 were sentenced for continuous sexual assault committed jointly: then the sentences could range between 12 and 15 years in prison but now they range from from 7 to 15, and with the same arguments as in the previous case, they adjust the sentence to the upper half of the range.

The judges have reduced the sentence of another man convicted in 2019 for sexual assault with the use of weapons from 12 to 7 years, because he was sentenced to the legal minimum at that time and the current minimum has dropped.

Another revised sentence has reduced the sentence from 5 years to 3 and a half years for a man convicted in 2020 for sexual assault – in his case, with an extenuation for having taken drugs – because the legal minimum sentence has dropped from 6 to 4 years and, adding the mitigation, in his case he must be between 2 and 4 years in jail.

It has also reduced the sentence of a man convicted of attempted sexual assault and robbery with violence from 15 to 9 and a half years, arguing that the law most favorable to the prisoner should be applied.

On the other hand, the court has ruled out reviewing the sentence of a man convicted in 2020 to 7 and a half years for sexual assault on a minor, because in his case the current law provides, like the previous one, sentences of between 5 and 10 years in prison.
