The Government maintains that the file has not expired and that, even if it did, it would not prevent it from continuing to claim

In 2020, the Balearic Health Service (IbSalut) issued a certificate of compliance with the order of masks from the key company in the Koldo case, despite the fact that it had already received, two months before, the results of the analyzes confirming that the material did not meet the requirements for an FFP2 mask.

This certification was made on August 12, 2020 at the request of the company, Soluciones de Gestión y Apoyo a Empresas SL, and was signed by a deputy director of Purchasing and Logistics, as reported in a press conference by the current director of IbSalut, Javier. Urena.

Ureña has clarified that it is common for companies to request this type of certificates to be able to present them when participating in other public contracts. The document certifies that, for IbSalut, the contract had been executed “correctly and satisfactorily.”

However, already on June 8, 2020, the state center that analyzed the material had issued a report concluding that the masks did not meet the requirements of an FFP2 mask. The material continues to this day stored in Son Dureta, already expired and unused.

For those currently responsible for IbSalut, this August certificate “makes it difficult for the claim of 2.6 million euros from the company to succeed, an amount based on the price difference with a surgical mask. In fact, the company used this document in the allegations presented in November, in addition to protesting that the administration is demanding the termination of a contract executed three years earlier.

On the other hand, the Government has denied that the claim – formally initiated, it assures, in August 2023 – has expired, since according to its calculations the deadline would remain in force until April.

However, both Ureña and the minister of the Presidency and Public Administrations, Antònia Maria Estarellas, have insisted that this particular file does not condition their ability to claim the funds.

In fact, the Government plans to claim not only the 2.6 million euros for the difference in price, but also the total amount of the contract, 3.7 million, and plans to “exhaust all avenues” necessary to do so. In this sense, Estarellas has announced that the Government’s appearance before the National Court has already been formalized.
