ACAIP-UGT emphasizes that the “insufficiency of riot gear” is proven and that adequate security measures were not taken

The Provincial Court of Cuenca has sentenced to ten years in prison the inmate who in October 2021 seriously assaulted a head of Cuenca prison services, whom he stabbed in the neck with two pieces of glass after hiding in the bathroom of his cell . In addition, you will have to compensate the official with 23,312 euros as civil liability.

The sentence, consulted by Europa Press, condemns the inmate of Moroccan nationality for the crimes of attempted homicide and attack, as well as for a minor crime of damages, applying an attenuation of mental illness for “the so-called schizophrenic defect”. ACAIP-UGT, which filed the private prosecution, stresses that the “insufficiency of riot gear” is proven and that adequate security measures were not taken.

The judges, however, consider that his behavior cannot be attributed to a psychotic outbreak because when the events occurred “his volitional and intellectual faculties were not annulled.”

In his record there are alleged crimes of sexual assault, violation of sentence and attack, highlighting the magistrates that he was classified in the first degree -the most restrictive- “due to his conflict and aggressiveness.”

It is also on record that he was subjected to restrictions on the life regime on eleven occasions due to dangerousness and isolation measures on six occasions, with five incidents with prison officers, two of them causing injuries. One of these incidents occurred in the Villena prison (Alicante), which led to the opening of a file for a reduction with possible excess force and an investigation for threats that later turned out to be simulated.

The sentence of January 17 indicates, however, that “there is no record” that the Cuenca official who was seriously attacked in the neck “was informed at any time of the accused’s prison record.” This official recorded in writing that the prisoner, who was admitted to an ordinary cell, “seriously threatened and insulted other inmates,” even breaking material from the establishment.

The day the incident was recorded, six officers entered his cell with prior authorization due to the repeated beatings that the inmate was giving. The workers distributed the existing riot gear, two helmets. “There were not enough shields for the six officials”, it is indicated in the proven facts.

It also reflects that once they entered “the cell was totally destroyed and the defendant had even broken the window panes.” The inmate was hiding in the bathroom and pounced on the head of services “with the intention of causing his death”, maintaining his aggressive attitude after wounding him in the neck.

The private prosecution filed by the ACAIP-UGT lawyer in turn requested that the administration be declared as subsidiary civil liability “for not having taken the appropriate security measures with the inmate and not responding to the request for transfer to a more appropriate center with their profile”, according to this union.

In a statement, ACAIP-UGT has assessed as “extremely serious” what happened in the Cuenca prison on October 27, 2021, disfiguring the “absolute contempt” of the General Secretariat of Penitentiary Institutions towards its workers for not attending the acts of protest called when the facts became known or that the “insufficiency of riot gear” has been proven.
