The Fourth Section of the Provincial Court of Valencia has sentenced a man who posted videos on his YouTube channel in which he insulted, harassed, harassed and threatened politicians or civil guards from Faura, the municipality where he lived, to three months in prison , as well as people from different ethnic groups residing in Spain.
The sentence, handed down after the parties reached an agreement whereby the convicted person acknowledged the crimes and showed his agreement with the sentence, also prevents him from going to the scene, that is, to the YouTube portal, for two years, which implies the closure of his channel and the impossibility of creating other accounts in it, as reported by the TSJCV in a statement.
The sentence condemns him for a crime committed during the exercise of the fundamental rights and public liberties recognized in the Constitution. In addition to the three months in prison, he received several fines -one for the hate crime, another seven for as many minor offenses of threats and an eighth for a minor offense of harassment- and six years of special disqualification from practicing any profession or trade. of the educational, educational, sports or leisure field. Finally, he agrees to the destruction and deletion of part of the released videos.
The events occurred during the first half of 2020 when, according to the account of proven facts contained in the resolution, the man published audiovisual material on his YouTube channel, accessible to any Internet user and with unlimited advertising potential, consisting of videos where he harassed, harassed and threatened different people known in Faura, such as members of the Civil Guard or political officials.
On that channel, according to the sentence, which was well known in the town, the condemned man also publicly expressed a “hostile, violent, denigrating and offensive” speech against the dignity of people of other races residing in Spain.
The now convicted defended his expulsion from the national territory of those ethnic groups and the non-recognition of their basic rights, using an “aggressive, defiant, contemptuous, and deeply offensive” tone with incitement to violence.
