It has also expelled two other people in 2019 in application of the ‘gag law’

The Government has reported that 90% of the 101 expulsions of foreigners to other countries carried out in the last decade have been processed for “activities against national security”, registering two cases justified by very serious infractions of the Organic Law on Citizen Security , the so-called ‘gag law’.
The data is contained in a written parliamentary response, consulted by Europa Press, in which EH Bildu wanted to know the reasons for the expulsions of foreign citizens in application of article 54.1 of Organic Law 4/2000 on the rights and freedoms of foreigners in Spain and its social integration.
Initially, the Government provided only the data for the 101 expulsions but later, on February 13, it specified the reasons. In this way, the only two expulsions in application of the ‘gag law’ were carried out in 2019, after the arrival of Pedro Sánchez to the Government.
This is the norm approved in 2015 by the PP that, after repeating the elections in 2019, the current coalition Executive of PSOE and Unidas Podemos promised to repeal, which has aroused misgivings among the main police unions.
In addition, the statistical system includes three expulsions in application of the previous citizen security law, that of 1992, which were distributed between the years 2013, 2016 and 2021.
For its part, for “attacking the security of the State-Terrorism” there are five cases: one in 2012, three in 2013 and another in 2014.
In 2022, with data up to November, one expulsion had been authorized for activities against national security, while in 2020 and 2021, years affected by the COVID pandemic, three and five expulsions were carried out, respectively.
In the parliamentary response, the Government specifies that the variable of the State to which these 101 foreign citizens have been expelled is not available in the statistical system.
Article 54.1 of Organic Law 4/2000 on the rights and freedoms of foreigners in Spain and their social integration contemplates as very serious offenses participating in activities contrary to national security or that may harm Spain’s relations with other countries, as well as be involved in activities contrary to public order.
