The Constitutional Court (TC) has inadmissible due to a formal defect the appeal filed by Vox against the Catalan law that circumvents the sentence of 25% of Spanish, according to legal sources confirmed to Europa Press.

The deputies of the formation led by Santiago Abascal presented the appeal of unconstitutionality against the decree law the Decree-law of the Generalitat of Catalonia 6/2022, of May 30, which establishes the criteria applicable to the preparation, approval , the validation and revision of the linguistic projects of the educational centers considering that it served to “abandon once again the use of Spanish”.

The party alleged that the measure of the Generalitat was “a ploy” to give the schools a “legal shield” with which to be able to breach the 25% sentence. Specifically, the appeal questioned the fact that the Government resorted to the figure of the royal decree when, in its opinion, “there is no extraordinary and urgent need” that makes the use of this exceptional mechanism necessary.

The party argued that Catalan law affects the Constitution in reference to the right of Spaniards to know Spanish and the right to use it. “Co-official status must be subject to a pattern of balance or equality between the languages ??without granting prevalence or preponderance to one over the other,” he said.

On the other hand, the Plenary has rejected the incidents of recusal that the former president of the Generalitat Carles Puigdemont and the ex-councilors Toni Comín and Clara Ponsatí made to try to remove the magistrates Antonio Narváez and Enrique Arnaldo from certain deliberations related to the cause of the ‘process’ .
