JEREZ DE LA FRONTERA (CÁDIZ), Nov. 2 (EUROPA PRESS) –
The Eighth Section of the Provincial Court of Cádiz, based in Jerez de la Frontera, has sentenced the man accused of killing in December 2020 a man with whom he had arranged to meet for eight years, eleven months and 29 days in prison. sell him drugs in the town of Jerez, all this after the guilty verdict issued by a popular jury.
As explained by the TSJA, in the sentence, issued on October 26, the Court sentenced the defendant to eight years in prison for a crime of homicide and eleven months and 29 days in prison for a crime against public health, concurring in both crimes the analogous extenuating circumstances of confession and drug addiction. Likewise, it must compensate the mother and siblings of the victim with a total of 135,739 euros.
In its verdict, the jury considered it proven that the events took place around 3:00 p.m. on December 30, 2020, when the convicted man met the deceased in the vicinity of the Jerez bullring to sell him hashish, so that both went to look for the drug that the defendant had stored in his home.
Once there, the accused handed the victim three pieces of hashish with a total weight of 271 grams that he had stored there for sale and that were later recovered by the Police, after which the deceased kept them in his clothes but did not pay. the agreed price “with the excuse that the money was held by another friend who was waiting on the street”.
As the jury considered proven, both then went down to the building’s portal and, before reaching the portal, the victim showed the convicted man a simulated pistol and began to run, after which the accused took out a butterfly-type knife that he had with him and chased the deceased, hitting him several times in different parts of the body with the intention of hurting him and causing him various injuries.
When they were both on the sidewalk in front of the building’s entrance, the accused threw the deceased to the ground with a tripping leg and stabbed him near the heart –previously, and before falling to the ground, he had already stabbed him in the the same area near the heart–. One of those stab wounds pierced the left lung and entered the heart, causing rapid blood loss and death.
The jury ruled that, by directing the knife towards the heart area, the convicted man realized that it was possible, and even probable, that the victim could be injured and could die, despite which he stuck the knife in that area. on two occasions.
After the events occurred, the defendant returned to his home, while the policemen who arrived at the scene received instructions that made them call the telephone of that home. At that moment, the condemned man left his house voluntarily and recognized his intervention both in relation to the drug and to the injuries that the victim presented, which led to his arrest.
When the events occurred, the accused was a consumer of narcotic substances and had been for several years, with no evidence that his intellectual or volitional faculties were diminished at that time.
