File the investigative proceedings that were opened as a result of a complaint by the PP deputy Fernando Gutiérrez Díaz de Otazu

The Environment Prosecutor’s Office has seen no evidence of a crime in the installation by Morocco of some fish farm cages in the vicinity of one of the Chafarinas Islands, for which reason it has agreed to file the investigative proceedings that were opened as a result of a complaint by the PP deputy Fernando Gutiérrez Díaz de Otazu.

As reported by the Public Ministry, after performing various procedures it has been found that “the cages anchored to the seabed are outside the limits of 500 meters of delimitation of the area declared as a Special Conservation Area (ZEC)”.

From the Prosecutor’s Office they have stressed that the investigation has allowed the conclusion that “there are no indications of the commission of a criminal offense.” As they have specified, it has not been proven that serious damage has been caused to a protected area, nor that the protected habitat has been destroyed or seriously altered, nor that a risk of serious damage to the balance of natural systems has been created.

Thus, the Public Prosecutor has deemed it pertinent to file the open investigation proceedings. In any case, the file has been communicated to the General Directorate of Fisheries and Aquaculture Management of the Ministry of Agriculture, since –according to Law 23/1984 on Marine Crops– it is the body that should approve and authorize a project such as the described, and therefore, it would be up to you to submit it to the pertinent environmental evaluation.

The complaint of the PP deputy for Melilla occurred in May, four days after the president of the ‘popular’ met in Rotterdam (Holland), within the framework of the EPP congress, with the Prime Minister of Morocco, Aziz Ajanuch .

During that meeting, the leader of the PP, Alberto Núñez Feijóo, stated his will to “rebuild a foreign policy based on trust” and parliamentary consensus, and accepted his invitation to travel to Rabat, something he plans to do in the fall, according to sources. ‘popular’

At a press conference from the party’s headquarters, the general secretary of the PP, Cuca Gamarra, assured that her party hoped that the Government of Pedro Sánchez would continue to defend “respect” for the environment in the Chafarinas islands after the fish farm promoted by Morocco.
