He does not doubt that he will be able to undergo an investiture debate if the amnesty comes into force at the end of May

The lawyer Gonzalo Boye has assured this Friday that the former president of the Generalitat Carles Puigdemont is willing to return to Catalonia and has stopped, and has assumed that he will be the Junts candidate for the elections to the Parliament on May 12.

In an interview in Rac1 collected by Europa Press, he admitted that there is a possibility that the police could arrest Puigdemont when he crosses the Spanish border: “It is a possibility. What will not be able to prevent him from being president of the Generalitat if he wants to be.”

“The only ones who can prevent it are the Catalans when they vote,” Boye stressed, making it clear that the former Catalan president is willing to accept the consequences of his actions in a legal framework that will be different once the Amnesty Law comes into force.

For Boye, the president of the Government, Pedro Sánchez, and the president of the Generalitat, Pere Aragonès, fear that Puigdemont could attend the elections, win them and be inaugurated: “This is the fear, and it is justified.”

After guaranteeing that the necessary legal framework has been generated so that the former president can return with guarantees and exercise his political life in the terms he decides, Boye does not doubt that he will be able to undergo an investiture debate if the amnesty comes into force at the end of May.

Once it is published in the Official State Gazette (BOE), the lawyer considers that courts “will proceed to review all the cases in which the amnesty should be applied and will lift the precautionary measures in the corresponding cases, one of them being that of Puigdemont”.

He has also assured that he is concerned that the respect of judges and courts for legality is called into question and that they make a “conscientious objection to a law approved by the legislative branch.”
