The disappearance of the legal formula of the Andalusian School of Public Health could imply, among others, the loss of recognition as a WHO collaborating center

The Andalusian Association of Family and Community Nursing (Asanec) has recommended, before the Health and Consumer Commission of the Parliament of Andalusia, “the non-absorption, by the new Andalusian Health Institute (ISA), of the Andalusian School of Health Public (EASP)” when considering that, “the legal change of the public entity would mean the loss of recognition as a collaborating center of the World Health Organization (WHO), among other dysfunctions that the change in legal status entails.”

Asanec, in his appearance before the processing of the bill to create the Health Institute, states that “the EASP is a commercial company and at the time it is extinguished, dissolved or integrated into the ISA, thus losing its personality legal entity, the designation by the WHO would disappear, since under no circumstances could the assignment as a collaborating center of the international organization be transferred to the new institute.

In this way, the loss of the EASP’s assignment as a WHO collaborator would have “a high negative impact for the Ministry of Health and Consumer Affairs, since Andalusia does not have more collaborating centers than the EASP,” Asanec has stressed. .

This scientific society has indicated that, “the loss of international experience by the Andalusian School of Public Health would also entail the possibility of submitting to future international tenders, since public administrations, such as the administrative agencies or research results transfer offices cannot participate in certain tenders of the European Union, WHO, the Pan American Health Organization or the World Bank, among others.

This fact would affect the loss of international alliances of which the EASP is currently a part. It must be taken into account, Asanec said, that “this entity has been responsible during these years for the management of more than 82 million euros.”

Likewise, the extinction of the commercial company of the Andalusian School of Public Health would also mean the extinction of strategic agreements and university degrees, a total of 12 postgraduate degrees.

In short, “if the EASP were integrated into an administrative agency, the response capacity in the provision of its services could be affected by the loss of agility in project management, since the EASP is currently governed by the law commercial and not administrative”, pointed out the head of Asanec.

It should be remembered that article 1.3. of the bill for the creation of the Andalusian Health Institute 12-23/PL-000004, includes “the assumption by the Andalusian Health Institute of the purposes, functions, personnel and assets of the entities the Andalusian Public Foundation Progreso and Health and the Andalusian School of Public Health S.A, leading to the extinction, by legally established procedures, of their respective legal forms, public foundation and commercial company, respectively, being replaced by the legal personality of the Administrative Agency.”

For these reasons, the Andalusian Association of Family and Community Nursing, given its character as a scientific society, recommends “the incorporation of the EASP as a center attached to the ISA”, so that it contributes its experience and international projection, its strategic alliances and its recognized position as a collaborating center of the WHO, maintaining its commercial company regime to “avoid the loss of management, organizational and resource-raising capacity.”

The Andalusian Association of Family and Community Nursing has recommended to the Health and Consumer Commission of the Parliament of Andalusia that, in relation to the creation of two new bodies of officials in specialties of Biomedicine and Health Sciences, “their current wording because they understand that the creation of the specialties indicated in the bill of the Andalusian Health Institute contradicts current European legal regulations.

The old university study plans were extinguished in October 2010, based on the provisions of RD 1393/2007, which includes university degrees. Furthermore, “the professional classification that appears in Royal Legislative Decree 5/2015, which includes the consolidated text of the Law of the Basic Statute of Public Employees, has also not been taken into account.”

On the other hand, Asanec has recommended to the Health and Consumer Commission of the Parliament of Andalusia the additional creation of a Public Health and Health Management category in the ISA.

Asanec is the Andalusian Community Nursing Association made up of nurses from all over Andalusia who, without profit, work for and for the development of the profession.
