The acting Minister of Justice, Pilar Llop, has warned that the use of Artificial Intelligence to recreate behavior of minors with sexual content is a crime.
“This is not something that has arisen recently, years ago a person was arrested for the use of AI to recreate behavior of minors with sexual content, pure pedophilia and child pornography,” Llop concluded this Tuesday in statements to the media in the Congress of Deputies.
In this context, the person responsible for Justice has warned that crimes related to Artificial Intelligence and the recreation of sexual content “are becoming more and more sophisticated”, which is why she has demanded that this technology be used “always within a framework ethics and a reference framework”. “It can’t be used for this,” she pointed out.
Regarding the case of several minors involved in the alleged manipulation with Artificial Intelligence of images of girls (also minors) without clothes, reported by their families in Almendralejo (Badajoz), Llop has made reference to the fundamental principle of the superior protection of minors.
Thus, he explained that this has to mean that whenever interpretations of the legislation are made “it has to be with that perspective of the best interests of the minor.” “The best interest of the minor would lead us to think that there would also be criminal protection for victims against this type of behavior and criminal protection for children in general against the possession of child pornography carried out through Artificial Intelligence,” has assured.
However, the acting Minister of Justice has acknowledged that currently “there is practically no jurisprudence on this” in Spain.
Likewise, he explained that this type of crime generates “very important obstacles” in investigations because, to identify the victims, especially when they are manipulated images, “it costs a lot.”
“It takes us a lot of work, a lot of resources are used for it, but we have great professionals who are working. It is a very difficult job for the Security Forces and Corps that produces great wear and tear,” he said.
To combat this type of crime, the Ministry of Justice, according to Llop, is strengthening victim assistance offices, where they can also go “to ask for advice, to ask for help or to ask for any type of support.” “These are very serious, very serious behaviors and there should be no impunity even if they are manipulated images,” she concluded.
