The sentence of four and a half years in prison to footballer Dani Alves for sexual assault has been made by applying the first version of the ‘only yes means yes’ law, prior to the reform that toughened the sentences by raising the minimum number of years in prison for this crime.

The ‘yes means yes’ law reformed the Penal Code and stipulated sentences of four to 12 years for crimes of sexual assault; Therefore, Alves has been sentenced at the bottom of the range of this version of the rule, which is the one that applies to him.
On the other hand, the law reform in April 2023 specified that in cases of sexual assault in which there is violence or intimidation, the sentence range will be between six and 12 years.
In this way, the sentence that Alves received this Thursday is below the minimum set by the current law and which is the result of the ‘only yes is yes’ reform in April 2023.
