After her father’s illness, the exonerated woman used the money from a loan for medical treatment
Repara tu Deuda Abogados, the leading law firm in Spain in the processing of the Second Chance Law, has achieved a new debt cancellation in Las Palmas de Gran Canaria. Through the management of Repair Your Debt Lawyers, the Commercial Court No. 1 of Las Palmas de Gran Canaria has issued the Benefit of Exoneration of Unsatisfied Liabilities (BEPI) in the case of a woman who had accumulated a debt of 36,958 euros to whom I couldn’t cope. SEE JUDGMENTAs the lawyers of Repara tu Deuda explain, “his state of insolvency arose from requesting financing to undertake a business venture. Because his father became ill, he had to allocate that money for his treatment in his country of origin. At first he did not “He had no problem paying the installments. The family grew with two children, so he requested more loans to cover the old ones and survive. As a result of the pandemic caused by COVID-19, he lost his job.” As pointed out by Repara tu Debta, “Spain was one of the countries in the European Union that took the longest to incorporate the Second Chance Law into its legal system, doing so in 2015. It is a mechanism planned for the cancellation of the debts of natural persons, including in this point the self-employed. In this way, the Recommendation made in 2014 by the European Commission to implement a system that protects people who could not assume their debts was fulfilled. Although at first it was very unknown to society in general, the reality is that more and more people turn to it as the years go by. Some think at first that it is an excessively complex process, an idea that is eliminated as the procedures progress. In short, it is about proving that debts cannot be assumed despite the desire to do so. Since the firm was founded in September 2015, more than 20,000 individuals and self-employed people have decided to put their case in the hands of the office with the sole objective of leaving your debts behind and starting from scratch. This has meant that Repara tu Deuda has managed to cancel more than 180 million euros to date to people who have very different profiles and who come from different autonomous communities. This legislation allows both individuals and the self-employed to be released from all their debts if they meet a series of prerequisites. In general terms, it is enough that the bankrupt has not committed socioeconomic crimes in the last ten years, that he acts in good faith throughout the procedure and that the amount owed does not exceed 5 million euros. To those who cannot resort to the Law Second Chance, the firm offers the analysis of the contracts signed with banks and financial entities. Along these lines, the objective is to check if there are abusive clauses for the cancellation of credit cards, revolving cards, mini-credits, loans and mortgages and thus be able to claim from Cofidis, Moneyman, WiZink, Carrefour, Vivus, Banco Santander, CaixaBank, BBVA, Banco Sabadell, myKredit, Kviku, etc.
