The Madrid Prosecutor’s Office has requested through an appeal to the Court of Instruction number 28 of Madrid to reject the complaint of the Madrid Bar Association (ICAM) against the chief prosecutor of Madrid, Pilar Rodríguez, for the alleged revelation of secrets in the dissemination of an informative note regarding the case of Alberto González, partner of the regional president, Isabel Díaz Ayuso, legal sources have confirmed to Europa Press.
This is an appeal addressed to the court on which the complaint filed by the dean of Madrid lawyers against the chief prosecutor and the prosecutor Julián Salto for the alleged leak of the emails exchanged between the lawyer of Ayuso’s partner and the prosecutor in relation to the proceedings opened against Alberto González Amador for alleged tax fraud.
As reported by ‘ElEspañol’, the Prosecutor’s Office defends in its challenge document the “constitutional legitimacy” of the statement released in this regard with which, on the basis of data already released, it tried to confront “untrue” information.
After the judge opened proceedings, the College appeared as a party, filing a complaint against the unknown perpetrator of the events. For now, the court has not ruled on said person, according to ICAM sources telling Europa Press.
The events that occurred on March 14, in the opinion of the ICAM, “indicately offer constitutive characteristics of a crime of revelation of secrets provided for in article 417.2 CP, which sanctions the violation by an authority or public official — in the case that concerns us, of the representative of the Public Prosecutor’s Office–, of the duty of secrecy and discretion imposed by the Organic Statute of the Public Prosecutor’s Office”.
In this sense, regarding the authorship of the alleged crime, the ICAM already stated in its complaint that “the Public Prosecutor’s Office “exercises its functions through its own bodies.”
Since such a note emanates from the Provincial Prosecutor’s Office of Madrid, “it will be necessary to subjectively determine its mediate or immediate authorship.”
