The Ministry of Housing has enabled the State Reference System for Housing Rental Prices, a system that establishes the maximum and minimum prices of a home based on its characteristics (surface area, state of conservation, whether it has an elevator or not). , etc.).

The objective of the index is that homes “with less value” (smaller, older, without parking, etc.) cannot increase their price when compared to higher quality homes in the same area. This tool is homogeneous throughout Spain, tax-based and will be updated every year. To carry it out, the latest income tax return of the homeowners has been used, which in this year’s case is 2022.

Competence in housing matters lies with the regional administrations, so this system “can only” be applied if an autonomous community requests to declare one of its zones as a stressed area. Due to this, no area has been declared as stressed although the index is now available on the Ministry of Housing website.

The plan is to give a period of ten business days to examine the proposals of each autonomy. Once the Ministry has studied all the necessary requirements and if everything is “correct”, the different proposed areas will be declared as stressed areas. The rental limit may be applied to them from the established legal period – one or two days -.

Currently, only Catalonia has asked to declare 140 municipalities of the autonomous community as a stressed area. For their part, the Basque Country and Navarra will not yet have this system available: as they have different tax regimes, the Ministry has not been able to access the owners’ income, the basis for calculating it.

The Ministry will publish a resolution every quarter with a list of the stressed residential market areas.

The system includes homes located in residential buildings that are more than five years old and whose constructed area is not less than 30 square meters or more than 150 square meters.

Once an area is declared stressed, the rent of homes already rented will be frozen once the annual update clause is applied, which in 2024 is limited to 3%.

If the home has not been rented in the last five years or belongs to a large holder – that has more than ten homes or five in the same stressed area, as established by each autonomous community, whether a natural or legal person – the rent will be limited to the upper range of the index.

To access the Reference Price Index, one can use the search engine on the Ministry of Housing website. In it you must enter certain data: the address or cadastral reference of the home, its characteristics and the lease contract.

The Real Estate Cadastre provides some of these characteristics, such as the surface area or age of the building. Once all the data has been entered, the search engine automatically provides a range of home values ??expressed in euros per month of rent – a report that can be downloaded in pdf format -.

The application itself fills in information about the building, but you must specify the floor, in the case of a building with several neighbors.

And also specific details such as the energy certificate or specific characteristics such as common areas or garage availability. With all this, the application generates an indicative rental price.
